China Gives Further Clarification on Decree 152 Implementation

On April 24, representatives of USDEC and the USDA Foreign Agricultural Service met with Chinese officials regarding implementation of Chinese Decree 152. Members should take the following into account as they plan shipments to China after May 1, 2013.

  1. Irrespective of a history of shipping, the first shipment from each exporter shipped after May 1 will be considered a “first time” shipment by the Chinese government and will be subject to the expanded certificate of analysis (COA) requirements.
  2. Shipments subsequent to the “first time” shipment must be accompanied by a copy of the COA issued with the first time shipment.
  3. Shipments subsequent to the “first time” shipment must also be accompanied by a COA demonstrating product compliance with the items regulated by the Chinese government. See Table 1 below for an itemized list of what tests must be run, categorized by product category, for each non-“first time” shipment.
  4. All COAs issued by the exporter must correspond to the production date and/or lot number of the product being exported.
